Athlete v Gymnastics Australia
Pursuant to Gymnastics Australia’s Selection Appeals Policy (Policy), the Athlete disputed their non-selection to the International Championships team.
The NST Member considered submissions and evidence from the Parties, including Interested Parties, relevant Gymnastics Australia policies, and previous NST matters. The matter was validated on 11 April 2025, and determined on 16 May 2025.
The Athlete’s appeal was successful on the basis that Gymnastics Australia did not properly apply its selection policies as required upon the Athlete.
Specifically, the Athlete argued that had Gymnastics Australia given adequate weight to her performances during the qualification period, it should have resulted in the Athlete’s selection to the International Championships team.
Pursuant to the Policy, the NST Member exercised his discretion to select the Athlete to the International Championships team; however, the determination of the apparatus which the Athlete and Interested Parties would compete in, was to be decided by Gymnastics Australia.
