A Member of a National Sporting Organisation (NSO) challenged the findings and the proposed sanction to be imposed on him by the NSO. The Member had made comments during a publicly live-streamed sporting event, which were alleged to constitute sexual misconduct under the NSO’s Member Protection Policy.
The matter was heard by a sole NST Member in the NST General Division, who considered submissions and evidence from both the member and the NSO.
The NST Member found that the Members comments did not constitute sexual misconduct. The recommendation that the Member resign from a governance role within a State Sporting Organisation was found to be unenforceable and of no effect. The NST Member recommended that the Member issue an apology to the Complainant.
