Description:

The Applicant is an athlete and member of the Respondent, AusCycling, the National Sporting Organisation for cycling in Australia.

On 23 August 2026, the Applicant lodged an application with the National Sports Tribunal (NST) following the Respondent’s decision not to select him for the Under 23 Men’s team for the 2026 UCI Road World Championships to be held in Montréal, Canada (the Championships). The Applicant was the reigning Oceania Champion and contended that his championship title entitled him to an additional quota place at the Championships. 

The Applicant submitted that the relevant UCI regulations provided him with a personal entitlement to compete at the Championships as the reigning Continental Champion, subject only to satisfying the Respondent’s eligibility requirements. He argued that the Respondent had incorrectly treated the quota place as a discretionary selection decision and failed to properly apply its Selection Policy.

The Respondent submitted that the additional quota place remained subject to its selection processes and that it was entitled to decide not to utilise the quota, having regard to team performance objectives and the composition of the team.

On 3 September 2026, the Parties consented to the matter being determined on the papers and, accordingly, no oral hearing was held.

On 4 September 2026, the NST upheld the appeal. The NST found that the Applicant had already been selected by virtue of being the reigning Oceania Champion and that the Respondent’s role was limited to assessing whether he satisfied the applicable eligibility criteria. The NST determined that the Selection Policy had not been correctly applied, set aside the decision, and directly selected the Applicant for Australia’s team for the 2026 UCI World Championships.
